The Biden administration believes that Israel has most likely violated international standards in failing to protect civilians in Gaza but has not found specific instances that would justify the withholding of military aid, the State Department told Congress on Friday. Even so, the report — which seemed at odds with itself in places — said the United States had no hard proof of Israeli violations. The report, mandated by President Biden, also makes a distinction between the general possibility that Israel has violated the law and any conclusions about specific incidents that would prove it. CNN spoke to three Israeli whistleblowers who worked at the Sde Teiman desert camp, which holds Palestinians detained during Israel’s invasion of Gaza. An unfortunate symbiosis has developed between pro-Israel culture warriors like Republican Representative Elise Stefanik and the most self-indulgent fringe of pro-Palestinian campus protesters. Together they are, wittingly or unwittingly, shifting attention from the urgent emergency in Gaza, where Israeli Prime Minister Benjamin Netanyahu is poised to defy the United States and invade the southern city of Rafah, to the much smaller problem of campus antisemitism. The United States has none.” Within the movement, I imagine such rhetoric functions as a sign of total commitment, a no-going-back rejection of hollow liberal pieties. Since 2016, pro-Israel politicians have pushed versions of a bill called the Anti-Semitism Awareness Act, which would codify, for the purpose of enforcing federal civil rights law in higher education, a definition of antisemitism that includes rejection of Israel as a Jewish state. In the past, civil libertarians were able to head such legislation off, but that’s become harder in the current fevered climate.

CNN —The State Department is divided over whether Israel is using American-provided weapons in accordance with international law ahead of a fast-approaching deadline next week for Secretary of State Antony Blinken to make a determination to Congress. Human rights groups have accused Israel of committing war crimes and abuses during the war in Gaza. The State Department official Sunday did not give further details about which parts of the department are in favor of accepting Israel’s assurances, which are in favor of rejecting them, and which took no position. “We don’t comment on leaked documents, especially those purporting to contain classified information,” State Department spokesperson Matthew Miller said in a statement. While the report does not represent the US government’s own conclusions, Blinken said last week that the State Department was looking at the incidents.

CNN —The Biden administration announced a new rule Friday expanding safeguards against potential discrimination of gay and transgender Americans seeking medical care, in a reversal of Trump-era limitations that nixed federal health protections for members of the LGBTQ+ community. In a set of expansive new rules unveiled by the Department of Health and Human Services, the department moved to advance civil rights protections for patients by barring health providers and insurers receiving federal funding from discriminating against those seeking care on the basis of gender identity or sexual orientation. The HHS rule restores Obama-era protections for transgender patients that the Trump administration rolled back in 2020 — a move that was condemned by LGBTQ+ advocacy and human rights organizations. The finalized rule comes as access to gender-affirming care for transgender youth has been tangled in political controversy, with more than 20 states in recent years attempting to restrict youth access to such care. In theory, the legislation will see some landing in the UK sent to Rwanda where their asylum claim will be considered. (AP) — A requirement for Pennsylvania voters to put accurate handwritten dates on the outside envelopes of their mail-in ballots does not run afoul of a civil rights law, a federal appeals court panel said Wednesday, overturning a lower court ruling. A divided 3rd U.S. Circuit Court of Appeals ruled to uphold enforcement of the required date on return envelopes, a technical mandate that caused thousands of votes to be declared invalid in the 2022 election. A lower court judge had ruled in November that even without the proper dates, mail-in ballots should be counted if they are received in time. U.S. District Judge Susan Paradise Baxter said the envelope date is irrelevant in helping elections officials decide whether a ballot was received in time or if a voter is qualified.

The nearly 29-percentage-point gap in Navy Federal’s approval rates was the widest of any of the 50 lenders that originated the most mortgage loans in 2022. In addition, an analysis by staff of the Senate Banking Committee, which 10 Democratic senators cited in a letter asking federal regulators to review Navy Federal’s mortgage lending earlier this year, also found racial disparities in Navy Federal’s mortgage approval rates based on the publicly available data. A spokesperson for Navy Federal did not respond to a request for additional details about the analysis. Navy Federal described Adegbile’s analysis as an “external review,” but his law firm, WilmerHale, is also defending Navy Federal in a class-action lawsuit from Black and Latino borrowers who allege the credit union discriminated against them in mortgage applications. “Navy Federal should immediately put out the full investigative report and data analysis so that Navy Federal’s members have an opportunity for themselves to review the findings,” the statement said.
